Alles over samenwonen
U wilt gaan samenwonen. U huurt een busje of aanhangwagen, u zet de spullen in één huis en dat was het dan. Dat had u gedacht... Om te beginnen moet u zich goed realiseren dat samenwoners niet dezelfde juridische en fiscale positie hebben als gehuwden en geregistreerd partners. Samenwoners doen er dus verstandig aan om een aantal zaken goed te regelen. Het samenlevingscontract speelt daarbij een centrale rol, maar er zijn ook aandachtspunten als het testament, het partnerpensioen en de verzekeringen. En laten we het samenwonen in eigen of huurhuis niet vergeten.
Samenlevingscontract Hoe laagdrempelig het samenwonen op zichzelf ook is, u doet uzelf en/of uw partner tekort als u niet een en ander op papier zet. Dit kunt u regelen door een samenlevingscontract op te stellen. Waarom? Ten eerste om onderlinge afspraken schriftelijk vast te leggen. Ten tweede omdat u er fiscaal en financieel voordeel mee kunt behalen.
1. Schriftelijke afspraken Het gebeurt nog steeds te weinig dat samenwoners afspraken op papier zetten. Ten onrechte. Afspraken geven duidelijkheid als de relatie stukloopt of een van de partners overlijdt. Het best doet u dat in een samenlevingscontract. In zo’n document legt u onderlinge afspraken schriftelijk vast. U mag zelf weten welke afspraken u maakt, zolang ze niet in strijd zijn met de wet (afspraken die strijdig zijn met de wet zijn nietig). U zou zelfs kunnen afspreken dat u de hond uitlaat en uw partner de afwas doet. Er is geen ‘vormvereiste’, u mag zo’n samenlevingscontract helemaal zelf opstellen, al is het maar op een simpel A4’tje. Verstandiger is het om één en ander notarieel te laten vastleggen. Niet alleen omdat een notaris u kan adviseren over de afspraken, maar ook omdat een notariële akte in sommige situaties zelfs verplicht is om in aanmerking te komen voor bepaalde faciliteiten, zoals het fiscaal partnerschap of gunstigere voorwaarden bij erven (en soms ook voor het verkrijgen van partnerpensioen). De belangrijkste zaken die via het samenlevingscontract worden geregeld zijn de gemeenschappelijke kosten en bezittingen, de gemeenschappelijke woning en het ‘verblijvingsbeding’.
- de gemeenschappelijke kosten Samenwoners nemen ieder hun eigen spullen mee naar de nieuwe stek en op dat moment is duidelijk wat van wie is. Maar in de loop van de tijd worden spullen vervangen en nieuwe aangekocht. Vaak is het dan niet meer zo duidelijk, vooral omdat veel zaken gezamenlijk worden gekocht en de ene partner bijvoorbeeld meer dan de andere betaalt. Vaak wordt dan onderling afgesproken om nog een keer te verrekenen, maar daar komt vaak niets meer van terecht. Een oplossing hiervoor is het opstellen van een zogenaamde ‘staat van aanbrengsten’. Daarin wordt vermeld welke spullen van wie zijn. Deze lijst wordt aan het samenlevingscontract toegevoegd. Daarna is het belangrijk om deze lijst aan te passen bij nieuwe of vervangende aankopen.

Q: Has the month of May been a bit of grind? Are you expecting a better June or will the things be like this for some more time?
A: There isn�t any particular trigger for this. The action seems to have shifted beyond results into the monsoon. Right now, the monsoon seems to be okay.
One factor that can take the markets up would have to be commodity prices which are coming down even more sharply than what we had seen in some of the commodities. There is a case for some of the metals and energy related commodities to come down.
Unfortunately, the food grains might rally up again in terms of prices. Therefore, inflation is not likely to head down anytime at least in the next quarter. Effectively, we might have some selective opportunities as the food commodities start to move up.
The FMCG companies will perhaps be able to pass on some of the price increases. In the broader market, nothing will take it up. If metals start to fall off, then some of the heavyweights in the index may start to feel some pressure.
Q: What did you read of the petrol price hike? What ramifications does it have for the market and the sector?
A: The petrol price was expected post the election. People are dismayed that it has come immediately after the election results. Given the kind of price rise that we have seen in crude, either they had to increase the subsidy bill or raise the prices.
The obvious impact of that will be on inflation. If they pass it on to diesel, the impact will be slightly more. There is again another notch up negative for the inflation figures.
Beyond that it will begin to impact some demand in the longer-term. In the near-term, it is nothing that the market shouldn�t have already figured out.
Q: What is the risk? If we grapple with high inflation over the next three months, will the market get marked down a bit more by higher interest rates? Do you think much of it is in the price and we will do some time correction, but do not lose too much on price?
